Judge dismisses lawsuit alleging racial discrimination in Buffalo Fire Department

A lawsuit against the Buffalo Fire Department that claimed racial discrimination has been dismissed.  

The 14-year-old lawsuit was filed by 17 former and current African-American firefighters.  It accused the city of discriminating against African-American employees based on promotional and disciplinary policies.

U.S. District Judge John Curtin issued the dismissal, saying the suit failed to state its case against the fire department.   Curtin said there was a lack of evidence to support the claims.

The judge had previously ruled that promotional exams were not discriminatory toward African-Americans, as the black firefighters had alleged. Curtin, in a 2010 ruling, found the exams for lieutenant promotion to be valid.
