Erie County DA re-examining all pending marijuana cases

Erie County District Attorney John Flynn has announced that his office will re-examine all pending cases that involve criminal possession of marijuana.

Recent legislation passed by state lawmakers and signed by the governor now allows adults in New York to possess up to 3 oz. of marijuana for personal use.

Flynn said prosecutors will review cases based on the weight of marijuana the defendant allegedly possessed at the time of arrest, and criminal charges will be reduced, refiled or dismissed at the defendant's next court appearance.

The DA said defense counsel is not required to file a motion for dismissal. Meanwhile, low-level cannabis convictions will be vacated.
