Buffalo, NY – DNA testing has exonerated a Cheektowaga man of a rape he did not commit.
In 1984, Douglas Pacyon was accused of raping two women. He was acquitted in the case of one of the victims. But he was convicted of the second and spent nearly seven years in prison.
Two years ago, Pacyon's attorney, Thomas D'Agostino, filed a motion seeking DNA testing. And that testing showed both victims were attacked by the same man and that man was not Douglas Pacyon.
Monday afternoon, Erie County District Attorney Frank Sedita himself will appear before a judge to personally deliver a motion for Pacyon's exoneration.
Though authorities have his DNA, the identity of the attacker remains unknown.
