Buffalo, NY – All charges against Lynn DeJac are being dropped.
Erie County District Attorney Frank Clark made the announcement during a Wednesday morning news conference. Clark says a re-examination of the evidence in the case indicates that 13-year-old Crystallynn Girard died from an overdose of cocaine, not strangulation.
This creates another new twist in this ongoing murder case that traces back to 1993.
"Questions remain concerning from whom or from where Crystallyn obtained the cocaine," Clark said. "There is evidence that both Lynn DeJac and (DeJac's former boyfriend) Dennis Donohue possessed and used cocaine on that fateful morning."
DeJac served more than 13 years in prison for their murder of her daughter. But in November, DeJac was freed from prison when DNA evidence linked Donahue to the murder.
DeJac, 44, was to face a new trial this April.
"The question of the legal guilt for the death of Crystallyn has been answered," Clark said. "Questions concerning the defendant's moral guilt will no doubt remain."
This latest revelation is just unfolding. The attorney for DeJac was scheduled to meet with reporters Wednesday afternoon. WBFO is following the story.
