Lynn DeJac Released, Judge Orders New Trial

Buffalo, NY – Lynn DeJac is a free woman. DeJac who was convicted of killing her daughter 14 years ago was released Wednesday afternoon following a bail hearing.

WBFO's Eileen Buckley reports the shackles were removed from DeJac. She then hugged family members and walked out of the courtroom for a cab ride home.

Earlier Wednesday, Erie County Court Judge Michael D'Amico ordered a new trial for DeJac, based on recent DNA evidence that links her daughter's murder to her former boyfriend, Dennis Donahue. He is under arrest for another murder. But Donahue cannot be tried because he received immunity for providing grand jury testimony as part of the DeJac murder probe.

A trial date has not been scheduled.

District Attorney Frank Clark said he would not appeal D'Amico's decision and that he would not oppose her release. He did say his office will go forward with plans to retry DeJac.

At a hearing before D'Amico last week, defense attorney Andrew LoTempio argued that new DNA points to Donahue as Crystallyn's killer. But Assistant District Attorney Michael Marion vehemently argued the evidence is inconclusive.

Marion angrily suggested that LoTempio is arguing for DeJac's release based on sympathy and left-over public emotion over the bike path rapist case.
