No Charges for Mother Who Left Infant in Hot Car to Die

Arcade, NY – The Wyoming County District Attorney says he will not pursue criminal charges against a mother who left her infant child inside a hot vehicle for nine hours. Gerald Stout said the determination was made after a comprehensive investigation by his office and the Arcade Police Department.

It was one of the hotter days of the summer. On August 2nd, temperatures topped 90 degrees. When Lynn Brol arrived for work at an Arcade company, she left the vehicle, apparently forgetting that her child was still inside. Nine hours later, little Brayden Brol was found dead.

DA Gerald Stout said there appears to have been no criminal intent, and that he didn't see a reason to prosecute her for criminally negligent homicide.

Stout said Brol's negligence is inexcusable. But he said the criminal justice system is ill-equipped to deal with the circumstances surrounding a horrible accident like this one.

Stout said he'll leave it to a greater power than the state to judge the circumstances surrounding the tragic death.
