Common Council Works on Expediting Capozzi's Release

By Mark Scott

Buffalo, NY – Now that Buffalo resident Anthony Capozzi has been exonerated in two 1980s rapes in Delaware Park, bureaucracy is likely to keep him behind bars for a while longer. Capozzi has already served over 20 years in prison for the crimes.

This week, DNA evidence implicated Altemio Sanchez, the bike path killer, in those rapes. Buffalo Common Council Member Richard Fontana says efforts are being made to expedite Capozzi's release.

"I don't think he should sit in a jail cell while technicalities and legal proceedings are worked out," Fontana said. "I think he should be out of jail, getting the help he needs while those legal proceedings go on."

Fontana says Capozzi's attorney, the governor's office, and the Common Council are all looking for ways to get him out.

A court hearing that will lead to his release could be held as early as Monday.
