Buffalo, NY – The expected indictment of accused bike path killer Altemio Sanchez in last September's murder of Joan Diver of Clarence was finally presented by a grand jury Monday.
Sanchez pleaded not guilty to a charge of second degree intentional murder at his arraignment before State Supreme Court Justice Christopher Burns.
Joan Diver, the mother of four children, was reported missing last September 29th, 16 years to the day that UB student Linda Yalem was murdered. Her body was found two days later near a bike path where she frequently jogged.
District Attorney Frank Clark would not comment on the evidence that led to Sanchez's indictment in the Diver case. He previously confirmed that the suspect's DNA was found inside Diver's vehicle.
Clark did say the grand jury plans no more action against Sanchez. He cannot be charged with the rapes he's accused of committing because the statute of limitations has run out.
Clark said legal motions are likely to be argued over the next several months and that the soonest a trial will begin would be sometime in the Fall.
