Buffalo, NY – The wife of suspected bike path rapist Altemio Sanchez has been subpoenaed to appear before a grand jury Wednesday morning.
Erie County District Attorney Frank Clark tells WBFO News Kathleen Sanchez was served last week. Clark says she has been ordered to testify before a grand jury panel that is investigating the September death of Joan Diver of Clarence on the Newstead bike path.
Sanchez has not been charged in connection with the Diver case, although investigators say his DNA was found in Diver's vehicle. Clark says Mrs. Sanchez could appear Wednesday or ask that the subpoena be quashed based on martial privilege.
"Obviously, we would like to obtain whatever knowledge she may have about the event, which would not be covered by the marital privilege," Clark said. "Grand jury secrecy prevents me from getting specific in that regard. But in a general sense, we can ask her questions like 'Was he here? Was he there?' But we can't ask particular questions about any conversations they may have had."
Sanchez was arrested January 15th in connection with the 1990 death of UB student Linda Yalem, and the 1992 death of Majane Mazur of Buffalo.
