Holt's Seat Ruled Vacant

Buffalo, NY – A State Supreme Court Justice Wednesday ruled that Erie County lawmaker George Holt has lost his third district seat in the legislature.

It took Justice Kevin Dillon only a few days to rule on the arguments presented in court last Thursday. According to Justice Dillon, Holt's seat became vacant - by operation of law - when the former lawmaker pleaded guilty to crimes involving a violation of his Oath of Office.

Specifically, Holt pled guilty to tax fraud. Holt's attorney had argued in court that Legislature Chairwoman Lynn Marinelli did not have the authority to declare his seat vacant or took nullify all votes taken by Holt after that.

Marinelli said her actions were vindicated.

Marinelli said a committee for the third district will now take up the job of finding a replacement for Holt.

Holt's attorney, H. Todd Bullard, said he will consult with his client about whether or not to appeal the judge's decision.

As for Marinelli, the judge's ruling takes away one potential shadow from her bid to win the County Democratic party's endorsement for the County Executive's race.

Marinelli said it shows voters and party leaders that she has a firm grasp on governance.

But she isn't alone in her quest to lead the county.

Marinelli is just one of several top Democrats who have thrown their hats into the race. And Republicans are equally committed to finding a candidate voters will endorse.

One top potential candidate, developer and former New York Secretary of State Christopher Jacobs, announced Wednesday he will not run.

But Republican Party Chairman Jim Domagalski said they will find a strong contender.

Domagalski said their committee interview process will likely take another couple of weeks before a candidate is chosen.

Marinelli said she spoke with her party leaders this week, who are also still making their decision. Among the other Democrats vying for the nomination are Amherst Councilman Dan Ward and former Deputy County Executive James Keane.
