Buffalo, NY – Attorney General Eliot Spitzer is suing an Amherst nursing home for nearly $1 million in overpayments it received from the state's Medicaid program.
Spitzer's spokesman Brad Maione says the Rosa Coplon Jewish Home and Infirmary isn't guilty of fraud. He says a complex reimbursement system is at the heart of allegations.
"We're alleging that this particular home had improperly received payments for costs that are not lawfully reimbursable under the rules of the Medicaid program," Maione said.
Specifically, Spitzer accused Rosa Coplon of billing Medicaid for non-reimbursable administrative costs and salaries as well as advertising and marketing expenses.
The nursing home's attorney says he believes that when the case is resolved, his client will not have to pay anything.
