Judge rules downsizing should be on ballot

Buffalo, NY – State Supreme Court judge Frank Sedita has ruled that a downsizing proposing should appear on next months ballot.

That proposition would ask Erie County voters if they believe the legislature should be reduce from 15 to 11 members. But the Board of Elections said the proposition could not appear on the ballot because it was not certified by the County Clerk, violating election law.

But downsizing advocate Kevin Gaughan filed a lawsuit and is now celebrating a win. Gaughan is elated with the ruling.

The Attorney for the Board of Elections is expected to issue an appeal.
