Buffalo, NY – The Seneca Nation of Indians and Federal Government want the casino lawsuit transferred to the National Indian Gaming Commission.

This is the latest round of legal maneuvers surrounding the on-going Buffalo Creek Casino battle.

The Department of Justice filed a motion on behalf of the Gaming Commission and Department of Interior. It calls on Buffalo's U.S. District Court judge William Skretny to transfer the case to the Gaming Commission.

Earlier this month Skretny ruled that the casino land is sovereign, but gaming is illegal at the site based on a land claims. Chris Karns is Counsel for the Seneca's. Karns says the remand is based on recent changes in a law by the Interior Department.

The Seneca's, who are not part of the lawsuit, also filed an amicus brief in support of the federal motion to transfer the case to the NIGC.
