Capozzi's Rape Convictions Vacated, Release from Prison Imminent

Buffalo, NY – A seven-minute court hearing Monday cleared Anthony Capozzi of the rape charges he was convicted two decades ago.

Erie County Judge Shirley Troutman vacated two rape convictions, based on recently discovered DNA evidence that linked the crimes to another man.

Capozzi is expected to be freed from custody later this week.

His lawyer, Thomas D'Agostino, says Capozzi remains at the Central New York Psychiatric Center in Marcy while authorities arrange for his release. The crimes Capozzi was blamed for have recently been linked by DNA evidence to Altemio Sanchez, the accused bike path killer.
